By taking lessons with AB Driving School, you agree to the Terms & Conditions as set out below:

Driving Instructor

1.1  I am a self-employed independent driving instructor and am not franchised to a local or national driving school

1.2  I am registered with the DVSA as an Approved Driving Instructor (ADI) and my ADI registration is up to date. I shall display my current DVSA ADI registration certificate in any vehicle that I use for a lesson, and I will ensure that that ADI certificate is kept up to date at all times.

Lessons

2.1  You must inform me if there is any reason you are not fit to drive safely or legally. This includes but is not limited to; loss of license, prescribed medication, influence of drink or drugs

2.2  You must be medically fit to drive. You must be able to read a number plate from 20.5 metres. If you have a medical condition and are unsure how it affects driving please consult your doctor prior to starting lessons (you may need to report to the DVLA any notifiable medical condition.)

2.3  I reserve the right to withdraw the use of the tuition car for driving lessons and practical driving tests if I believe you are unsafe, not legal, or not up to test standard. If I believe that you are not up to test standard, we will discuss this before your test and discuss the options available to you.

2.4  I reserve the right to refuse to take you to your driving test if you haven’t told me when your driving test is and therefore I am unavailable, if you haven’t moved your driving test date when I advised you to, if you haven’t had regular lessons, or I believe you are unsafe to be driving my tuition car by yourself on test.

Booking, Cancellation & Delays

3.1  If you cancel your lesson with less that 48 hours notice, you will be liable for the cost of what your lesson would have been charged at.

3.2  You can cancel/amend you lesson without charge if you give me at least 48 hours notice. I will either refund you the payment or transfer it to the next lesson.

3.3  If due to exceptional circumstances including, but not limited to, serious illness, accidents and bereavement you cancel a lesson without giving me at least 48 hours notice, I will consider the circumstances and, at my discretion, decide whether to waive any charge.

3.4  All matters relating to the timing, location and duration of individual lessons shall be subject to agreement between you and I.

3.5  I will not reserve any lesson slots or guarantee regularity of lessons over any period of time except when I have received payment for those lesson slots and agreed on those lesson slots in advance. Nevertheless, I shall use reasonable endeavours to make available regular lesson slots for you.

3.6  On arrival for your lesson, I will wait at the pick-up location. If you have not arrived after 5 minutes I will send you a message/call. If you do not arrive or have failed to contact me after 15 minutes I will send you a message cancelling your lesson and you will be charged as above.

3.7  If you are late for your lesson, your lesson time will be reduced as I cannot be late for my next student. You will still be charged the full price of the lesson, as this is considered ‘cancelling’ part of your lesson with less than 48 hours notice.

3.8  If I have to cancel your lesson through no fault of my own, for circumstances such as mechanical breakdown of the tuition car, bad weather which may affect your ability to learn safely, heavy traffic, or the previous student’s lesson or driving test has overrun for unavoidable reasons, and it means I cannot arrive at your lesson within good time, I will rearrange your lesson for the next available, mutually convenient, date and time or refund the payment for that lesson.

3.9  I will use all reasonable endeavours to start your lesson at the time booked however, if I am late to your lesson for reasons such as the above, I will inform you and you will still receive the full lesson time. If that is not suitable I will either refund that lesson, add the missed time to another lesson or rearrange the lesson for a mutually convenient time.

3.10  If I feel your behaviour or attitude whilst driving is threatening, dangerous, or compromises safety or I have reason to believe you are not fit to drive at the time of the lesson, I reserve the right to cancel the lesson in progress and any future lessons. I shall be entitled, at my discretion to charge you for that lesson or not to do so, but in deciding whether to charge you I shall act reasonably.

Payment

4.1  Your hourly lesson or block rate is as agreed with AB Driving School.

4.2  I accept payments in the form of Bank Transfer or payment via the Total Drive App.

4.3  All lesson payments must be made upfront in advance of each lesson.

4.4  I cannot issue a refund for any lessons already taken. If you are dissatisfied with a lesson for any reason please talk to me as soon as possible.

4.5  If you have paid for a block rate and you need to discontinue lessons part way through your block for any reason, the lessons taken will be charged at full price and the remaining hours will be refunded.

4.6  Lessons prepaid will be valid at the price in force at the time of booking for 6 months fromthe date of purchase. Refunds will not be given for lessons not taken after this timeperiod.

4.7  I may change fees without prior notice but any lesson fees already paid will remain at thatprice.

4.9  You can obtain information on your own lesson hours remaining on the Total Drive App.

Accidents & The Law

5.1  I make every effort to avoid damage and accidents, and I do anticipate that accidents may happen as you are learning to drive, however if I believe you were driving in a dangerous manner or ignoring my instructions and actual damage is caused to the tuition car, you may be expected to contribute towards the repairs cost (i.e. tyres).

5.2  I will make every effort to avoid you breaking the law or committing any traffic offence – you are under my close supervision during every lesson and I may use controls such as speed limiters, and verbal or physical control such as giving verbal instruction, taking the steering wheel or using the dual control pedals where necessary, to avoid dangerous situations or accidents, however I cannot accept any responsibility of you breaking the law – this includes speeding, traffic offences, regulations, or laws that you could break whilst driving. Any fines or penalties are legally the sole responsibility of the driver. It is an offence on my part, if I fail to give the driver’s details to the DVLA or Police when asked to provide that information as to who was driving at the time of an offence.

5.3 I will ensure the vehicle provided is fitted with dual controls, fully roadworthy, taxed, valid MOT and fully insured for the purposes of driving instruction.

Data Protection

6.1  In line with the GDPR, by you taking driving lessons with me, you automatically consent and agree to me holding your personal information (such as your name, address, date of birth, driving licence number, records of your driving progress, medical conditions that may affect your driving, driving test dates, receipts of payments etc.). I hold your information in line with the Data Protection Act 1998 and for the purpose of being able to provide good quality driving lessons to you.

6.2  You must inform me of any changes to your information that may affect me in providing driving lessons to you – such as a change of address, new medical conditions, etc.

6.3  I hold your information securely, which is either locked away securely, or secured on our phones, tablets, or computers which are all password protected.

6.4  I can assure you that I do not pass your information on to anyone without your prior permission and agreement- unless required to do so by law.

6.5  You have the right to see any information I hold about you.

6.6  You have the right to ask me to destroy any information I hold about you.
